PostHeaderIcon Care Company Shells Out £1 Million in Compensation


Excelcare, a 20 year old care company located in Essex county, is facing rough weather with it recently having to shell out £ 1 million to its former employees on charges of having dismissed them unfairly. This was reported by the newspaper Essex echo. Apparently 115 members of the organization were dismissed from the organization because they refused to accept a lower pay. Excelcare was forced to introduce pay cuts because it was unable to finance the running of 10 care homes it had taken on.

The spokesperson of the trade union Unison, Anne Vinden says that this step is very welcome especially since the workers involved don earn too much and therefore have a greater need to be protected legally.

Excelcare’s defense of this situation is that it was forced to take this step as it was the only alternative they had, besides closing down the care homes. Apparently the Essex County council did not provide the company with adequate funds to operate the homes.

The enraged employees approached a tribunal at Bury Stedman’s. This tribunal , post a 14 day hearing decided to award compensation to the employees in varying amounts from £1000 to £30,000, amounting to£1 million. This is an encouraging piece of news for care workers all over, as in case of any discrepancy regarding their employment, they always have the choice of tackling it legally. In such a case a lawyer who is a specialist in dealing with such cases.

An employment specialist lawyer at KCJ, Annalie King says that companies that are involved in the care sector run an extra risk of facing such cases especially since the basis of this sector is interaction with people on a day to day basis. She is of the opinion that companies in the care sector must always take advice before taking any strong steps.

All organisations need to make appropriate efforts to protect the well-being of staff, Workplace Law provide courses by the Chartered Institute of Personnel and Development (CIPD), which impart training to managers to successfully manage appropriate policies and procedures and improve upon management skills to help tackle stress in the workplace.
